Acești termeni sunt regulile pentru folosirea ReadEasyLex (aplicația web și versiunea ei instalabilă). Prin folosirea aplicației, acceptați acești termeni. Dacă nu sunteți de acord, vă rugăm să nu folosiți aplicația.

Ce este ReadEasyLex și cine îl oferă

ReadEasyLex este o aplicație gratuită, fără conturi, care îi ajută pe copiii cu dificultăți de citire, inclusiv pe cei cu dislexie, să citească mai ușor. Ea afișează textul mai clar, îl citește cu voce tare, recunoaște textul din poze și PDF-uri și oferă exerciții și jocuri scurte cu sunete și litere.

Serviciul este oferit de Hunor-Uwe Szász-Gerőcs, persoană fizică, Cluj-Napoca, România. Ne puteți scrie la uweszasz@gmail.com.

Cine poate folosi aplicația

• Aplicația este făcută pentru copii, părinți, profesori și terapeuți (de exemplu logopezi).
• Copiii o folosesc cu acordul și sub supravegherea unui părinte, a unui tutore sau a unui adult care are grijă de ei.
• Părintele sau tutorele acceptă acești termeni pentru copil și face alegerile din ferestrele de acord (vocea online și Google Analytics).
• Profesorii și terapeuții pot folosi aplicația cu copiii de care se ocupă, cu respectarea regulilor școlii sau ale cabinetului.

Nu este un serviciu medical și nu pune diagnostice

Acesta este cel mai important punct din acești termeni.

• ReadEasyLex este un instrument de citit și de exersat. Nu este un dispozitiv medical și nu oferă sfaturi medicale, psihologice sau terapeutice.
• Jocurile cu sunete și litere și testul de viteză de citire arată doar cum a răspuns copilul în acel moment. Ele nu sunt un test psihologic, nu sunt o evaluare de specialitate și nu pun un diagnostic de dislexie sau de altă tulburare.
• Un rezultat bun nu exclude dislexia. Un rezultat slab nu o confirmă. Dislexia poate fi stabilită doar de un specialist calificat, după o evaluare completă.
• „Rezumatul pentru consilierul școlar” cuprinde notițele părintelui și rezultatele din aplicație. Nu este un raport al unui specialist.
• Dacă aveți îngrijorări legate de citit, de vorbire sau de dezvoltarea copilului, adresați-vă unui specialist (de exemplu unui psiholog sau unui logoped). Nu amânați acest pas din cauza aplicației.

Un serviciu gratuit, oferit „așa cum este”

• Folosirea ReadEasyLex este gratuită. Dacă vom introduce vreodată funcții plătite, nu veți plăti nimic fără să vă arătăm înainte prețul și condițiile și fără să le acceptați în mod expres.
• Facem tot ce putem ca aplicația să funcționeze bine, dar nu garantăm că va fi mereu disponibilă, fără erori sau potrivită pentru orice dispozitiv.
• Recunoașterea textului, pronunția și definițiile pot avea greșeli.
• Putem schimba, opri temporar sau închide aplicația ori unele funcții.
• Datele dvs. sunt salvate doar în browser. Dacă ștergeți datele browserului, schimbați dispozitivul sau browserul le șterge singur, ele se pierd și noi nu le putem recupera. Tipăriți sau salvați ce vreți să păstrați.

Textele și fișierele pe care le deschideți

• Toate drepturile asupra textelor, pozelor și fișierelor pe care le deschideți rămân ale dvs. sau ale autorilor lor.
• Puteți deschide doar materiale pe care aveți dreptul să le folosiți. De exemplu: manualele și fișele de la școală, pentru studiul personal al copilului, sau materialele scrise de dvs.
• Nu folosiți aplicația pentru a copia sau a distribui materiale protejate de drepturi de autor fără acordul titularului, în afara cazurilor permise de lege.
• Materialele rămân pe dispozitiv. Dacă porniți vocea online, ne permiteți să trimitem textul citit la Microsoft doar pentru a-l transforma în sunet și să păstrăm sunetul cel mult 60 de zile.
• Dacă trimiteți un text pe telefon, dvs. răspundeți de persoanele cărora le dați codul QR sau linkul.

Folosirea corectă

Nu aveți voie:

• să folosiți aplicația într-un mod care încalcă legea sau drepturile altor persoane;
• să încercați să accesați fără drept serverele noastre sau să ocoliți limitele lor;
• să trimiteți automat, în masă, cereri către vocea online sau să o folosiți pentru alte aplicații sau servicii;
• să introduceți viruși sau alte programe dăunătoare;
• să copiați, să modificați sau să decompilați aplicația, în afara cazurilor permise expres de lege, ori să eliminați mențiunile despre drepturile de autor;
• să folosiți numele ReadEasyLex sau mascota Lex astfel încât să pară că vă susținem sau că suntem asociați cu dvs.

Dacă cineva folosește abuziv serviciul, putem limita sau bloca accesul la vocea online și la celelalte funcții de pe server.

• Aplicația, codul, designul, textele, clipurile audio cu vocea naratorului și mascota Lex sunt protejate de drepturi de autor (Legea nr. 8/1996).
• ReadEasyLex™ și Lex sunt semne distinctive folosite de noi.
• Vă dăm un drept gratuit, personal și neexclusiv să folosiți aplicația pentru citit și învățat, inclusiv la clasă și în ședințe de terapie. Nu aveți voie să o revindeți, să o republicați sau să faceți din ea o altă aplicație.
• Unele definiții în limba engleză provin din Simple English Wiktionary și sunt folosite sub licența CC BY-SA 4.0, așa cum este menționat în aplicație. Ele pot fi refolosite potrivit acelei licențe.
• Unele componente ale aplicației (de exemplu programele pentru PDF și pentru recunoașterea textului) sunt programe open-source, cu licențele lor proprii.
• Acești termeni nu limitează excepțiile pe care legea le permite tuturor (de exemplu copia pentru uz personal).

Răspunderea

În măsura permisă de lege, nu răspundem pentru:

• pierderea datelor salvate pe dispozitivul dvs.;
• greșelile de recunoaștere a textului, de pronunție sau din definiții;
• deciziile luate doar pe baza rezultatelor din aplicație;
• întreruperile cauzate de internet sau de furnizori externi (Cloudflare, Microsoft, Google, jsDelivr);
• pierderile indirecte.

Nu excludem și nu limităm răspunderea pentru prejudiciile cauzate cu intenție sau din culpă gravă și nici pentru vătămarea vieții, a integrității corporale sau a sănătății (art. 1355 din Codul civil). Nimic din acești termeni nu vă ia drepturile pe care legea vi le dă și care nu pot fi înlăturate prin contract.

Părinții și adulții care îi supraveghează pe copii răspund de felul și de timpul în care copiii folosesc ecranele.

Datele personale și modificarea termenilor

Folosirea datelor este explicată în Politica de confidențialitate. Putem actualiza acești termeni: data de sus arată ultima versiune, iar schimbările importante le anunțăm în aplicație. Dacă nu sunteți de acord cu noua versiune, puteți înceta oricând să folosiți aplicația.

Dacă o prevedere din acești termeni nu este valabilă, celelalte rămân valabile.

Legea aplicabilă și litigii

Acești termeni sunt guvernați de legea română. Dacă aveți o problemă, scrieți-ne mai întâi la uweszasz@gmail.com, ca să găsim împreună o soluție. Dacă nu reușim, litigiul va fi soluționat de instanțele competente potrivit legii. Dacă locuiți în alt stat, vă păstrați protecția pe care v-o dau regulile obligatorii din țara dvs.

These terms are the rules for using ReadEasyLex (the web app and its installable version). By using the app, you accept these terms. If you do not agree, please do not use the app. This is a translation; if it differs from the Romanian version, the Romanian version applies.

What ReadEasyLex is and who provides it

ReadEasyLex is a free app, with no accounts, that helps children who find reading hard, including children with dyslexia, to read more easily. It shows the text more clearly, reads it aloud, recognises text in photos and PDFs, and offers short exercises and games with sounds and letters.

The service is provided by Hunor-Uwe Szász-Gerőcs, private individual, Cluj-Napoca, Romania. You can write to us at uweszasz@gmail.com.

Who can use the app

• The app is made for children, parents, teachers and therapists (for example speech and language therapists).
• Children use it with the consent and under the supervision of a parent, guardian or another adult caring for them.
• The parent or guardian accepts these terms for the child and makes the choices in the consent windows (online voice and Google Analytics).
• Teachers and therapists may use the app with the children in their care, following the rules of their school or practice.

Not a medical service, and no diagnosis

This is the most important point in these terms.

• ReadEasyLex is a tool for reading and practising. It is not a medical device and does not give medical, psychological or therapeutic advice.
• The sound and letter games and the reading-speed check only show how the child answered at that moment. They are not a psychological test, not a specialist assessment, and they do not diagnose dyslexia or any other condition.
• A good result does not rule out dyslexia. A weak result does not confirm it. Dyslexia can only be identified by a qualified specialist after a full assessment.
• The "summary for the school counsellor" contains the parent's notes and the results from the app. It is not a specialist's report.
• If you have concerns about your child's reading, speech or development, see a specialist (for example a psychologist or a speech and language therapist). Do not delay this step because of the app.

A free service, provided "as is"

• Using ReadEasyLex is free. If we ever introduce paid features, you will pay nothing without first being shown the price and conditions and expressly accepting them.
• We do our best to make the app work well, but we do not guarantee that it will always be available, error-free or suitable for every device.
• Text recognition, pronunciation and definitions may contain mistakes.
• We may change, pause or close the app or some of its features.
• Your data is saved only in the browser. If you clear the browser's data, change device, or the browser deletes it by itself, it is lost and we cannot recover it. Print or save anything you want to keep.

The texts and files you open

• All rights in the texts, photos and files you open remain yours or their authors'.
• You may open only material you have the right to use. For example: school textbooks and worksheets, for the child's personal study, or material you wrote yourself.
• Do not use the app to copy or distribute copyrighted material without the rights holder's permission, except where the law allows it.
• The material stays on the device. If you turn on the online voice, you allow us to send the text being read to Microsoft only to turn it into sound, and to keep that sound for at most 60 days.
• If you send a text to a phone, you are responsible for who you give the QR code or link to.

Fair use

You may not:

• use the app in a way that breaks the law or the rights of others;
• try to access our servers without permission or get around their limits;
• send automated, mass requests to the online voice or use it for other apps or services;
• introduce viruses or other harmful programs;
• copy, modify or decompile the app, except where the law expressly allows it, or remove the copyright notices;
• use the ReadEasyLex name or the Lex mascot in a way that suggests we endorse you or are associated with you.

If someone abuses the service, we may limit or block access to the online voice and the other server features.

• The app, its code, design, texts, narrator voice clips and the Lex mascot are protected by copyright (Romanian Law no. 8/1996).
• ReadEasyLex™ and Lex are distinctive signs that we use.
• We give you a free, personal, non-exclusive right to use the app for reading and learning, including in class and in therapy sessions. You may not resell it, republish it or turn it into another app.
• Some English definitions come from Simple English Wiktionary and are used under the CC BY-SA 4.0 licence, as credited in the app. They may be reused under that licence.
• Some components of the app (for example the PDF and text-recognition programs) are open-source programs with their own licences.
• These terms do not limit the exceptions the law allows everyone (for example a copy for personal use).

Liability

As far as the law allows, we are not liable for:

• loss of data saved on your device;
• mistakes in text recognition, pronunciation or definitions;
• decisions made only on the basis of results from the app;
• interruptions caused by the internet or by outside providers (Cloudflare, Microsoft, Google, jsDelivr);
• indirect losses.

We do not exclude or limit liability for harm caused intentionally or through gross negligence, nor for harm to life, physical integrity or health (Art. 1355 of the Romanian Civil Code). Nothing in these terms takes away rights the law gives you that cannot be removed by contract.

Parents and the adults supervising children are responsible for how and for how long children use screens.

Personal data and changes to these terms

How data is used is explained in the Privacy policy. We may update these terms: the date at the top shows the latest version, and we announce important changes in the app. If you do not agree with a new version, you can stop using the app at any time.

If a provision of these terms is not valid, the others remain valid.

Applicable law and disputes

These terms are governed by Romanian law. If you have a problem, please write to us first at uweszasz@gmail.com, so we can find a solution together. If we cannot, the dispute will be settled by the competent courts according to the law. If you live in another country, you keep the protection given by the mandatory rules of your country.

Хто може користуватися застосунком

• Батьки або опікун приймають ці умови за дитину і роблять вибір у вікнах згоди (онлайн-голос і Google Analytics).
• Учителі й терапевти можуть використовувати застосунок із дітьми, з якими працюють, дотримуючись правил школи чи кабінету.

Це не медичний сервіс, і він не ставить діагнозів

Це найважливіший пункт цих умов.

• ReadEasyLex це інструмент для читання і тренування. Він не є медичним виробом і не надає медичних, психологічних чи терапевтичних порад.
• Ігри зі звуками й літерами та перевірка швидкості читання показують лише, як дитина відповіла в той момент. Вони не є психологічним тестом чи фаховою оцінкою і не ставлять діагнозу дислексії чи іншого розладу.
• Добрий результат не виключає дислексії. Слабкий результат її не підтверджує. Дислексію може визначити лише кваліфікований фахівець після повного обстеження.
• «Підсумок для шкільного психолога» містить нотатки батьків і результати із застосунку. Це не висновок фахівця.
• Якщо вас турбує читання, мовлення чи розвиток дитини, зверніться до фахівця (наприклад, психолога чи логопеда). Не відкладайте цей крок через застосунок.

Безкоштовний сервіс «як є»

• Користування ReadEasyLex безкоштовне. Якщо ми колись запровадимо платні функції, ви нічого не платитимете, доки ми не покажемо ціну й умови і ви прямо їх не приймете.
• Ми робимо все можливе, щоб застосунок працював добре, але не гарантуємо, що він завжди буде доступний, без помилок чи придатний для будь-якого пристрою.
• Розпізнавання тексту, вимова і визначення можуть містити помилки.
• Ми можемо змінити, тимчасово зупинити або закрити застосунок чи окремі його функції.
• Ваші дані зберігаються лише в браузері. Якщо ви очистите дані браузера, зміните пристрій або браузер сам їх видалить, вони будуть втрачені, і ми не зможемо їх відновити. Роздрукуйте або збережіть те, що хочете залишити.

Тексти і файли, які ви відкриваєте

• Усі права на тексти, фото і файли, які ви відкриваєте, залишаються за вами або їхніми авторами.
• Відкривати можна лише матеріали, які ви маєте право використовувати. Наприклад: шкільні підручники й робочі аркуші для особистого навчання дитини або матеріали, написані вами.
• Не використовуйте застосунок, щоб копіювати чи поширювати матеріали, захищені авторським правом, без дозволу правовласника, крім випадків, дозволених законом.
• Матеріали залишаються на пристрої. Якщо ви вмикаєте онлайн-голос, ви дозволяєте нам надсилати текст, що читається, до Microsoft лише для перетворення на звук і зберігати цей звук не довше 60 днів.
• Якщо ви надсилаєте текст на телефон, ви відповідаєте за те, кому передаєте QR-код чи посилання.

Чесне використання

Заборонено:

• використовувати застосунок у спосіб, що порушує закон або права інших людей;
• намагатися без дозволу отримати доступ до наших серверів чи обійти їхні обмеження;
• надсилати автоматичні масові запити до онлайн-голосу або використовувати його для інших застосунків чи сервісів;
• поширювати віруси чи інші шкідливі програми;
• копіювати, змінювати чи декомпілювати застосунок, крім випадків, прямо дозволених законом, або видаляти позначки авторського права;
• використовувати назву ReadEasyLex чи талісман Лекса так, ніби ми вас підтримуємо або пов’язані з вами.

Якщо хтось зловживає сервісом, ми можемо обмежити чи заблокувати доступ до онлайн-голосу та інших серверних функцій.

• Ми надаємо вам безкоштовне, особисте, невиключне право користуватися застосунком для читання й навчання, зокрема в класі та на терапевтичних заняттях. Ви не можете перепродувати його, повторно публікувати чи робити з нього інший застосунок.
• Деякі англійські визначення взято з Simple English Wiktionary і використано за ліцензією CC BY-SA 4.0, як зазначено в застосунку. Їх можна повторно використовувати відповідно до цієї ліцензії.
• Деякі складники застосунку (наприклад, програми для PDF і розпізнавання тексту) є програмами з відкритим кодом із власними ліцензіями.
• Ці умови не обмежують винятків, які закон дозволяє всім (наприклад, копію для особистого використання).

Відповідальність

Наскільки це дозволяє закон, ми не відповідаємо за:

• втрату даних, збережених на вашому пристрої;
• помилки розпізнавання тексту, вимови чи у визначеннях;
• рішення, ухвалені лише на підставі результатів із застосунку;
• перебої, спричинені інтернетом чи зовнішніми постачальниками (Cloudflare, Microsoft, Google, jsDelivr);
• непрямі збитки.

Ми не виключаємо й не обмежуємо відповідальності за шкоду, заподіяну умисно чи через грубу недбалість, а також за шкоду життю, фізичній цілісності чи здоров’ю (ст. 1355 Цивільного кодексу Румунії). Ніщо в цих умовах не позбавляє вас прав, які дає закон і які не можна скасувати договором.

Батьки і дорослі, які наглядають за дітьми, відповідають за те, як і скільки часу діти проводять перед екранами.

Персональні дані і зміни умов

Як використовуються дані, пояснено в Політиці конфіденційності. Ми можемо оновлювати ці умови: дата вгорі показує останню версію, а про важливі зміни ми повідомляємо в застосунку. Якщо ви не згодні з новою версією, ви можете будь-коли припинити користуватися застосунком.

Якщо якесь положення цих умов недійсне, решта залишаються чинними.

Застосовне право і спори

Ці умови регулюються правом Румунії. Якщо у вас виникла проблема, будь ласка, спершу напишіть нам на uweszasz@gmail.com, щоб ми разом знайшли рішення. Якщо це не вдасться, спір розглядатимуть компетентні суди відповідно до закону. Якщо ви живете в іншій країні, за вами зберігається захист, який надають обов’язкові норми вашої країни.
